These Terms of Use (“Terms”) govern your use of the website www.vishwasetupublication.com (“Website”), owned and operated by Vishwa Setu Publication, having its office at Plot No. C48, Sector 12, Kharghar, Navi Mumbai – 410210, Maharashtra, India (“Vishwa Setu Publication”, “we”, “us”, or “our”).

By accessing, browsing, or using this Website, including accessing any audio tracks, digital resources, or teacher materials, you (“you”, “user”) agree to be bound by these Terms. If you do not agree, please do not use the Website.

These Terms should be read together with our Privacy Policy and Shipping / Refund / Cancellation Policy, which are available on the Website.

1. Eligibility and Acceptance

1.1. By using this Website, you confirm that:

  • you are at least 18 years of age, or

  • you are using the Website under the supervision and consent of a parent/guardian or an authorised school representative.

1.2. If you are using the Website on behalf of a school, institution, or organisation, you confirm that you are authorised to act on its behalf and to bind it to these Terms.

1.3. Your continued use of the Website after any changes to these Terms will constitute your acceptance of those changes.

2. Changes to the Website and Terms

2.1. We may update, modify, suspend, or discontinue any part of the Website (including features, content, and availability of digital resources) at any time without prior notice.

2.2. We may revise these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. You are responsible for reviewing the Terms periodically.

3. Nature of Services

3.1. The Website is primarily intended to:

  • provide information about our books and publications, including the Pragyan Hindi series;

  • offer audio tracks and digital learning resources linked to our books;

  • enable teachers and schools to request and access additional support material;

  • facilitate communication between you and Vishwa Setu Publication regarding orders, queries, and academic support.

3.2. While we may provide information about book pricing and accept orders via email/WhatsApp or other channels, the Website may not function as a full online payment gateway. Payment arrangements may be separately communicated via invoice, email, or other written communication.

4. User Accounts and Teacher Login

4.1. Certain parts of the Website, especially teacher resources, may require you to create an account or receive login credentials.

4.2. When you create an account or request access:

  • you must provide accurate, current, and complete information;

  • you must promptly update your details if they change.

4.3. You are responsible for:

  • maintaining the confidentiality of your username, password, and any other login information;

  • all activities that occur under your account.

4.4. You must not:

  • share your login details with unauthorised persons;

  • allow students or others to use your teacher login unless expressly permitted by us.

4.5. We may suspend or terminate your account at any time if we reasonably suspect misuse, unauthorised sharing of resources, or violation of these Terms.

5. Orders, Pricing, and Payments

5.1. The prices of books and products shown on the Website are indicative and may change without prior notice. The final price, applicable discounts, shipping charges, and payment terms will be confirmed in your proforma invoice or written communication from us.

5.2. We may offer discounts to schools, distributors, or other institutional buyers as per our current discount policy, which may be communicated separately.

5.3. Payment methods (such as bank transfer, UPI, online payment link, etc.) will be specified in the invoice or by email/WhatsApp.

5.4. An order will be treated as confirmed only after we acknowledge receipt of payment (or as otherwise agreed in writing).

5.5. Our Shipping / Refund / Cancellation Policy forms part of these Terms and will govern all matters relating to delivery timelines, shipping methods, cancellation, refunds, if any, and no-return conditions.

6. Intellectual Property Rights

6.1. All content on the Website, including but not limited to:

  • text, book descriptions, sample chapters, worksheets;

  • audio tracks and recordings;

  • images, illustrations, graphics, logos, icons;

  • videos, PDFs, downloadable files;

  • design, layout, and look and feel of the Website

is the exclusive property of Vishwa Setu Publication or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws in India and internationally.

6.2. You are granted a limited, non-exclusive, non-transferable licence to access and use the Website and its content for personal study or classroom teaching purposes, in accordance with these Terms.

6.3. Except as expressly allowed under these Terms or with our prior written permission, you must not:

  • copy, reproduce, distribute, republish, download, display, post, or transmit any part of the Website or its content in any form;

  • modify, adapt, translate, create derivative works from, or exploit the content for commercial purposes;

  • remove or alter any copyright, trademark, or other proprietary notices.

7. Use of Audio Tracks and Digital Content

7.1. All audio tracks, recordings, transcripts, worksheets, PDFs, and any other digital content made available through this Website (collectively, “Digital Content”) are the exclusive property of Vishwa Setu Publication and are protected by the Copyright Act, 1957, and other applicable laws.

7.2. Licence to use
When you purchase a Pragyan book or receive authorised access from Vishwa Setu Publication, we grant you a limited, non-exclusive, non-transferable licence to:

  • download and/or access the relevant audio tracks and other Digital Content;

  • use them only for your personal learning or for classroom teaching with students who are using the Pragyan books.

7.3. You may store the audio files and Digital Content on your personal or school devices (e.g., phone, tablet, laptop, school computer) as reasonably required for such permitted use.

7.4. Restrictions
Without our prior written permission, you must not:

  • share, forward, distribute, or give copies of the audio tracks or Digital Content to anyone who has not legally purchased or been authorised to use the Pragyan books;

  • upload or post any audio tracks or Digital Content to public or semi-public platforms (including but not limited to websites, blogs, YouTube, Vimeo, Google Drive, school portals open to the public, WhatsApp groups, Telegram channels, file-sharing services, or social media);

  • modify, edit, remix, translate, add background music, sound effects, or otherwise create derivative works based on the audio tracks or Digital Content;

  • use the audio tracks or Digital Content in any other publication, textbook, course, or commercial product;

  • sell, rent, license, or commercially exploit the audio tracks or Digital Content in any way;

  • remove, obscure, or alter any copyright or ownership notices.

7.5. School and teacher use

  • Schools and teachers who have adopted Pragyan books may play the audio tracks in class, or via a secure learning platform, only for enrolled students.

  • Raw audio files or Digital Content must not be placed in any openly accessible area (e.g., public website pages, open Google Drive folders, or publicly shared links).

7.6. We reserve the right to suspend or terminate access to Digital Content and/or your account if we reasonably believe our content is being misused, shared, or distributed in breach of these Terms. Unauthorised use may also lead to civil or criminal action under applicable law.

8. User Conduct and Prohibited Uses

You agree not to use the Website:

8.1. For any purpose that is unlawful, harmful, or prohibited by these Terms.

8.2. To transmit any material that is:

  • defamatory, obscene, offensive, or otherwise objectionable;

  • infringing upon any third party’s intellectual property or privacy rights;

  • harmful to children or minors.

8.3. To attempt to gain unauthorised access to any part of the Website, other users’ accounts, or any systems or networks connected to the Website.

8.4. To introduce any viruses, malware, harmful code, or use any automated system (including bots, crawlers, or scrapers) to access the Website without our permission.

8.5. To copy, mirror, or frame any part of the Website without our prior written consent.

9. User-Submitted Content (Feedback, Testimonials, etc.)

You grant Vishwa Setu Publication a worldwide, royalty-free, perpetual, irrevocable licence to use, reproduce, display, and publish such content (in whole or in part) for promotional, educational, or other lawful purposes, in any media, with or without credit, unless you explicitly request in writing that your name not be used.

10. Privacy and Data Protection

10.1. Our collection, use, storage, and protection of your personal information are governed by our Privacy Policy, which is an integral part of these Terms.

10.2. By using the Website and submitting your personal data (e.g., via Request Access or Contact forms), you consent to the collection and use of your information in accordance with our Privacy Policy and applicable data protection laws, including the Digital Personal Data Protection Act, 2023 (as and when in force), to the extent applicable.

You agree to indemnify, defend, and hold harmless Vishwa Setu Publication, its owners, authors, and employees from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to:

  • your use or misuse of the Website or Digital Content;

15. Termination

15.1. We may, at our sole discretion, suspend or terminate your access to the Website (including your account and Digital Content access) at any time, with or without notice, if we reasonably believe that you have violated these Terms or applicable law.

15.2. Upon termination, your right to use the Website and Digital Content will immediately cease, but any obligations incurred or rights accrued prior to termination will survive.

16. Governing Law and Jurisdiction

16.1. These Terms shall be governed by and construed in accordance with the laws of India.

16.2. Any disputes arising out of or in connection with these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the courts at Navi Mumbai / Mumbai, Maharashtra, India.
